In cases where as of the first day of the Application Acceptance Period the seller does not hold title to the property, the acquisition price for purposes of §10.302(c)(2) will be limited to the acquisition price between the seller and the current title holder.  If the seller is acquiring more land from the current title holder than will be conveyed to the Applicant [whether under a single or multiple purchase contract(s)], the value ascribed to the proposed Development Site will be determined according to §10.302(e)(1)(A).
