Staff may propose amendments to the Department’s Previous Participation rule (linked below). This online form is designed to ask questions about the current rule and exchange ideas for improvement.

Previous participation reviews are completed prior to award of Department funds and prior to approval of an ownership transfer.  Events of noncompliance that were not corrected during the corrective action period are taken into consideration and, along with portfolio size, form the basis of designating an application as a category 1, 2, 3 or 4.

Category 1 applications are those that have no previous participation, have not been monitored or corrected all identified events of noncompliance during the corrective action period.

Category 2 applications have some events of noncompliance, but by rule, are deemed acceptable. 

Category 3 and Category 4 applications are reviewed by the Department’s Executive Award Review Advisory Committee (“EARAC”).

In addition to any general questions, feedback or ideas about the rule, staff is specifically seeking input on proposed terms and conditions, portfolio category determination, and portfolio size.
